Terms of Use

RecruitAutomate, at recruit.thebriminc.com, is the recruitment platform of TheBriminc (thebriminc.com; "we", "us"). These terms apply to everyone who uses the platform, and to candidates we contact through it. By signing in, or by replying to our messages, you accept them. Our Privacy Policy explains how we handle personal information and forms part of these terms.

1. The service

RecruitAutomate helps TheBriminc's team receive job applications, assess them against the roles we recruit for, contact candidates by WhatsApp and email, and keep track of interviews, offers and joining for our client companies. It is a tool for our own recruitment work; it is not a public job board, and there is nothing to buy in it.

2. Who may use the platform

• Signing in is by invitation only: for TheBriminc's recruiters and administrators and other people we authorise. You must be at least 18.
• You may use the platform only for TheBriminc's recruitment work and only within the role you were given.
• Candidates do not need an account: we contact them by WhatsApp or email, and they reply there.

3. Your account

• You sign in with your Google account. Keep that account secure (we recommend two-step verification) and do not let anyone else use your access.
• You are responsible for what is done with your access. Tell us at once at jobs@thebriminc.com if you think someone else has used it.
• The WhatsApp number you give us is shared with the candidates you are responsible for, as their point of contact; keep it current.

4. Acceptable use and confidentiality

Candidate and client information in the platform is confidential. When you use it, you agree:

• to use personal information only for the recruitment purpose it was collected for, and as our Privacy Policy and India's Digital Personal Data Protection Act, 2023 require;
• not to copy, download, export or share candidate or client information except as your work needs, and never outside TheBriminc and the client company concerned;
• not to name a confidential client to a candidate, and not to contact a candidate who has asked us to stop;
• to make hiring decisions yourself, fairly and lawfully, and not on the basis of anything the law protects (such as religion, caste, gender or disability);
• not to upload anything unlawful, harmful or that you have no right to use, or files meant to damage the platform;
• not to try to get around access limits, probe or overload the platform, or reach data your role does not allow;
• not to use the platform to send messages that are not about genuine roles, or to send spam.

These duties continue after your access ends.

5. If you are a candidate

• We contact you about roles you applied for or that match your profile, by WhatsApp or email. Please give accurate information; your answers are recorded with your application.
• Reply STOP to any WhatsApp message to stop WhatsApp messages from us, for every role; reply START to resume. You can ask for a call or for a person at any time.
• Being contacted, shortlisted or interviewed is not a promise of a job. Hiring decisions are made by TheBriminc's recruiters and by the client company, which may have its own terms and process.
• Your mobile operator's usual charges may apply to messages you send.
• Your rights over your personal data, and how to use them, are in our Privacy Policy.

6. AI assistance

The platform uses AI to read resumes and replies and to suggest how a profile matches a role. Its readings can be wrong. They help our recruiters, who check them; they never decide anything on their own. Users must not treat an AI reading as a fact without looking at the source it quotes.

7. Services of other companies

The platform relies on services of other companies — among them Google (sign-in, Gmail, Google Drive), Meta's WhatsApp Business Platform through Gupshup, AI providers, and the companies that host it. Their own terms apply to your use of their services, and we are not responsible for their availability or conduct.

8. Ownership

• The platform, its software, design and content belong to TheBriminc or its licensors. You may not copy, sell or re-use them except as these terms allow.
• Candidates keep the rights in their resumes. By sending a resume or answers to us, a candidate allows TheBriminc to store, process and share them for recruitment as our Privacy Policy describes.

9. Availability and changes

We work to keep the platform available, accurate and secure, but it is provided "as is": it may be interrupted for maintenance or by problems outside our control, and we may change, add or remove features at any time.

10. Responsibility and liability

• To the extent the law allows, TheBriminc is not liable for indirect or consequential loss, or for loss caused by services of other companies, by information others provide, or by misuse of access.
• Nothing in these terms limits liability that cannot be limited by law, or your rights as a Data Principal under the DPDP Act.
• If you break these terms you are responsible for the harm it causes, and we may take the steps in section 11.

11. Suspension and ending access

We may suspend or end a user's access at any time, in particular when their work with TheBriminc ends or these terms are broken. A user may stop using the platform at any time. What happens to personal information afterwards is set out in our Privacy Policy.

12. Governing law

These terms are governed by the laws of India. Disputes are subject to the jurisdiction of the courts where TheBriminc has its registered office.

13. Changes to these terms

We may update these terms. The date at the top shows the latest version; for significant changes we will tell users in the platform. Continuing to use it after a change means you accept the new terms.
